These Terms of Service (“Terms”) govern your use of jouelanity.com (the “Site”) and every purchase you make through it. By placing an order you confirm that you have read and accept these Terms, together with our Shipping Policy, Return & Refund Policy, Warranty and Privacy Policy, which form part of these Terms. Links to all of them are shown at checkout before you pay.
1. Who we are
The Site is operated by Jouelanity, an independent online jewelry and watch retailer with its registered business address at 1500 Magruder St #538, El Paso, TX 79925, United States. You can contact us at support@jouelanity.com (Monday to Friday, 9:00 am to 5:00 pm Mountain Time (El Paso, TX)). In these Terms “we”, “us” and “our” mean Jouelanity, and “you” means the customer placing an order.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract to order from the Site. By ordering you confirm that the information you give us is accurate and that you are authorized to use the payment method you provide. We ship only to street addresses in the United States.
3. Products, brands and accuracy
- We take care to describe every product accurately, including materials, dimensions, movement type, water-resistance rating and the name of the actual manufacturer. Specifications are those published by the manufacturer and are reproduced with acknowledgement. Colors may vary slightly between screens, and natural materials vary from piece to piece.
- Jouelanity is an independent retailer. We are not affiliated with, sponsored by or endorsed by any brand sold on the Site. Brand names and trademarks belong to their respective owners and are used only to identify the products.
- All products are genuine. We do not sell counterfeit, replica or “inspired by” goods.
- If we discover an error in a description or price after you have ordered, we will contact you and give you the choice of confirming the order at the correct information or cancelling it for a full refund.
4. Prices and what you pay
- All prices are in US dollars (USD).
- Shipping to US addresses is free.
- A flat 10% import duties & taxes charge is added to the product subtotal at checkout, because orders ship from Hong Kong. Jouelanity is the importer of record and pays the carrier and US Customs directly.
- The order total shown at checkout – product price plus the 10% import duties & taxes charge, with free shipping – is the full amount you will be charged. The carrier will not collect any duty, tax, brokerage or other fee from you on delivery.
- We may change prices at any time, but changes do not affect orders we have already accepted.
5. Placing an order and acceptance
- Your order is an offer to buy. We send an automatic order confirmation email when your order is received; the contract is formed when we send the dispatch email.
- We may decline or cancel an order before dispatch if an item is unavailable, a price or description was wrong, payment cannot be verified, the delivery address is a PO box, APO/FPO or otherwise undeliverable, or we reasonably suspect fraud. If we do, we refund any amount paid in full.
- You may cancel an order for a full refund at any time before the dispatch email is sent by emailing support@jouelanity.com.
6. Payment
We accept PayPal and Visa card payments at checkout. Payment is taken when you place the order. Card and PayPal details are processed by the payment provider over an encrypted connection; Jouelanity does not see or store your full card number.
7. Shipping, delivery and risk of loss
Orders are dispatched by our fulfillment partner from its warehouse at Chung Shun Knitting Centre, Kwai Chung, Hong Kong via FedEx. Handling takes 2-3 business days and transit 5-7 business days, giving an estimated delivery time of 7-10 business days. Delivery times are estimates. Title to the goods passes to you on delivery; risk of loss passes to you when the parcel is delivered to the address you gave us. Our Shipping Policy explains what happens if a parcel is late, lost or damaged.
8. Returns and refunds
You may return eligible items within 30 days of delivery under our Return & Refund Policy. Damaged, defective or incorrect items are replaced or refunded in full at our cost.
9. Warranty
Watches and jewelry carry a 12-month limited warranty against manufacturing defects, as set out in our Warranty page. Except as stated there and in the Return & Refund Policy, and to the extent permitted by law, products are otherwise supplied without further warranty.
10. Your account
You may check out as a guest or create an account. You are responsible for keeping your password confidential and for activity under your account. Tell us immediately at support@jouelanity.com if you believe it has been used without your permission.
11. Intellectual property
The text, photographs, graphics and layout of the Site are owned by Jouelanity or used with permission and may not be copied or reused without our written consent. Manufacturer specifications and trademarks remain the property of their owners.
12. Acceptable use
You agree not to use the Site for any unlawful purpose, to interfere with its operation, to attempt to gain unauthorized access to it, or to place fraudulent or speculative orders.
13. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by negligence or for fraud. Subject to that, our total liability to you in connection with any order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss, loss of profit or loss of data. The Site is provided “as is”; we do not guarantee uninterrupted or error-free access.
14. Governing law and disputes
These Terms and any dispute arising from them are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules, and you agree to the jurisdiction of the state and federal courts located in El Paso County, Texas. This does not affect any consumer-protection rights you have under the law of the state where you live. We encourage you to contact us first – almost every issue can be resolved by email.
15. Changes to these Terms
We may update these Terms from time to time. The version in force when you place an order applies to that order. The date of the latest revision is shown at the top of this page.
